Homesly Terms

Homesly is operated by Schmosby, LLC d/b/a Homesly.

1. The agreement

By creating a Homesly account or using the Service, you agree to these Terms and the Homesly Privacy Policy. These Terms form a binding agreement between you and Schmosby, LLC, a South Dakota limited liability company doing business as Homesly. Material updates are announced by email and in-app at least 30 days before taking effect.

2. Who can use Homesly

You must be at least 18, a United States resident, legally able to enter into a contract, and use the Service for lawful purposes only. Homesly is a strict 18-and-older service — no teen accounts, no parental-consent flows. We verify date of birth at signup and close any account on discovery that the holder is under 18.

3. What Homesly is, and what it isn’t

Homesly is a home record platform. Our recommendations, scores, and estimates are informational; they are not a replacement for licensed inspectors, contractors, financial advisors, insurance professionals, or real estate brokers.

4. Your account

Provide accurate registration information, protect your credentials, and notify us at security@welcomehomesly.com if you suspect compromise.

5. Your home record

  • Information you record is yours. You can export at any time.
  • Your “claim” on a home asserts that you are the legal owner or authorized resident. We validate via soft signals; you may need to provide documentation in a dispute.
  • When you sell and the new owner claims the home, your access converts to read-only historical view. The new owner inherits the record.
  • Historical service records are immutable after an initial editing window to preserve record integrity.
  • You grant Homesly a license to host, process, and display your content to operate the Service and to support consented commercial sharing.
  • Up to 5 family members per property.

6. Data export and deletion

Export and delete at any time via Settings → Data & Privacy.

7. Acceptable use

No unlawful use, no impersonation, no falsified records, no harassment, no security probing without coordinated disclosure, no bots/scraping, no reverse engineering except as permitted by law, no spam, no reselling.

8. Subscriptions, fees, and payment

  • Free, Plus, and Pro tiers as listed on Pricing.
  • Paid subscriptions auto-renew at the then-current price until canceled. We send a reminder email before each annual renewal and at least 30 days before any material price increase.
  • 30-day Pro free trial, no card required.
  • One-click cancellation:cancel any time from Settings → Subscription → Cancel. The cancellation flow is no harder, no longer, and no more steps than the enrollment flow, in compliance with the FTC Negative Option Rule (16 C.F.R. Part 425), California ARL, NY GBL § 527-a, and equivalents.
  • Cancellation takes effect at the end of the current billing period.
  • Per-pull Inspector ($19.99) and Home Record Summaries ($29.99) are non-refundable.
  • Taxes added where required.

9. Contractors are not us

Homesly matches you with Contractors but is not a party to any agreement, transaction, or relationship that forms between you and a Contractor. Verification is a baseline, not an endorsement.

10. Integrations

Smart-home, calendar, and email integrations operate under the third party’s terms. Disconnect at any time in Settings.

11. Home Record Summary and Inspector Reports

Generated only when you authorize. Shareable links expire after 30 days by default. Recipients may save and share within the transaction parties.

12. Commercial partners

Manufacturers, insurers, inspectors, and real estate agents purchase products from Homesly under separate agreements. Your category-by-category consent in Settings controls what data flows.

13. Intellectual property

Homesly’s brand, software, algorithms, prompts, and reports are ours. Your content is yours; you grant us a license to operate the Service. “Homesly,” “Homesly-Do,” “Home Record Summary,” the Homesly mark, and the wordmark are common-law trademarks (™) of Schmosby, LLC. United States federal trademark applications are pending.

14. DMCA

Copyright notices to copyright@welcomehomesly.com. Our designated agent is registered with the United States Copyright Office, Service Provider ID DMCA-1073209, on file in the DMCA Designated Agent Directory.

15. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Homesly disclaims all warranties, express or implied.

16. Limitation of liability

Homesly’s total cumulative liability is limited to the greater of the amount you paid us in the 12 months preceding the claim, or $100. We are not liable for indirect, incidental, special, consequential, or punitive damages.

17. Indemnification

You agree to defend and indemnify Homesly from claims arising out of your violations of these Terms, your content, your relationship with any Contractor, and your representations about property ownership.

18. Termination

You can terminate by deleting your account. We may suspend or terminate accounts that violate the Terms or are required by law to be closed.

19. Dispute resolution and arbitration

Please read this section carefully — it affects your legal rights.

We try to resolve disputes informally first. If we can’t, you and Homesly each agree to final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Class actions are waived. Small-claims and IP/security claims are carved out. You may opt out by emailing legal@welcomehomesly.com within 30 days of first acceptance.

20. Governing law

Governed by the laws of the State of South Dakota, without regard to conflicts. Disputes not subject to arbitration are heard in Minnehaha County, South Dakota.

21. General

Entire agreement, no waiver, severability, no assignment by you, notices by email or in-app, force majeure. California users may reach the California Department of Consumer Affairs at (800) 952-5210.
